Default Fixed Penalty Notice help wanted

I wonder if any of you have any knowledge of fixed penalty notices, My daughter was pictured stopped in a bus-stop dropping a passenger off and has received a fpn for £35.
Now there are 2 photos , the first shows the car stationary and the second taken 10 seconds later shows a passenger getting out of the n/s door.
Is this allowed or is there a waiting time allowed in bus-stops, Can you stop in a bus-stop at all or are they now no-go area's.
If you need to drop someone off is it better to stop before or after the bus stop or is it safer to pull-in
Can she appeal against this or is she just stuck having to pay????

all advice wanted please
Neil

If you or your daughter are a member of the AA or RAC why don't you ring their legal department and ask them?

Be careful. £35 will sound cheap if you take it to court and lose! That's a disgrace though. 10 secs? It's a wonder the whole road network didn't come to a halt.

my dad is a bus driver for newcastle (arriva) he says if it was newcastle city center area the cameras are automatic if a car enters a no car lane (where all the bus stops are) they get a pic taken and fined. according to him no cars are allowed in the bus stop as it a designated stopping area and suppose to be a safe area for passengers to disembark...so basically shes screwed and will have to pay

thanks for all the replies and its kinda as i thought but you never know do you
so if your driving along a road with railings and need to drop a passenger off BUT the only place with a gap is a bus-stop what are you supposed to do???????????
And is it better/less illegal to just stop in the middle of the road NEXT to but not IN the bus-stop will that make it any safer methinks not

Now i havent paid a PCN since 2007, ive also been to adjudication twice and had my appeals upheld. currently 17-0 to me

There are differences between a Fixed Penalty Notice and a Penalty Charge Notice - the wording is very important. If its a FPN the only people who can issue these are the police. If that's the case then I would just part with the money.
However PCN's are a different breed altogether, are issued by Enforcement Authorities (councils), either by camera and then posted to you (reg 10 PCN); or by hand and stuck to your car (reg 9 PCN) by a Civil Enforcement Officers (old school speak-traffic wardens).

Just because they take pictures doesn't mean anything - it just means they have a picture of an alleged contravention.
