Default chunks of rock

Ok so.. travelling southbound on the A19 and this big yellow volvo "road planing" truck with a large body (enclosed, not open top) is travelling in the left hand lane, while I'm about 200 yards behind him in the fast lane.

Then all of a sudden our lass gasps and points, a few rocks fall from underneath the vehicle. I thought these could have been brought in from the side of the road, but then saw a slab of this stuff fall from underneath the lorry and break into rocks, which are now bouncing about the road. As I'm the closest to the truck, I'm the main victim.

Anyway, a chunk of rock cracked my windscreen, another hit my bumper and then bounced a couple of times on my bonnet and went down the side. And then a bigger one hit my bumper and I saw it go up, so floored the car (in order to preserve our lass's life) and the rock landed on me roof.

So the damage is a load of chips, dents, cracked windscreen. The worst is a dent in the roof, and the rock has taken a load of paint off and the lacquer or whatever is underneath has come off too.

It's annoying, I've got the insurance details off the bloke. But what are my chances that I'm going to get anything here?

Nice one. It's just if he denies it or says it is impossible that it could have happened (cos he said that it could have been some debris dragged in from the side of the road) but seriously nothing could "drag" that amount of rock into the road. It definitely came from the truck. I'll keep you guys posted

chances are good nowadays, seems like people are cliaming left right and centre...a mate of mine has had an insurance claim against him as apparently he dented and scratched a car in a carpark with his car door...its funny as he claims he was parked there before the other car and wasnt there to do it...i wind him about it something rotten

Well I phoned up today since nothing was happening. They had the insured persons side of the story. He said his vehicle had just come back from cleaning and therefore it was impossible for it to have had anything on it. Hmm, fishy??

So the woman asked me to take some photos of the damage, So I am going to take some and send them in. She asked if I was going to use a solicitor or just deal with them. I said I'll stick to dealing with them but if it starts getting fishy I'm calling in a solicitor.

Did I do right?

tbh mate, now they know its just you they know they have a 90% chance of winning you over and not paying up. confuse you with all the legal garbel.

do you have legal protection with your car insurance?

if you do i would give them a ring, get them involved asap, they will deal with it all for you, sort you a courtesy car out if needed etc. thing is they should recover the costs of the other party insurance so you dont lose out at all.

i bet that the other driver is of the different side of society that they are showing a tv program on channel 4.

if they ring you or you ring them record the call, tell them before the conversion starts (otherwise its illegal(record asking them)). this is so you have a log and cover your own arse really. when they ask you something, think about what they just said carefully, ask them if you dont understand, and answer tactically.

you can also inform your insurance company, get them involved, the more power you put onto the third part the more of the chances of getting it sorted. but because it was not your fault and theres, this should not harm your NCB etc, if it does get out of that policy and get yourself a decent insurance company.

i just dealt with the insurance and dealing with a third party insurance company. so i know what its like lol

Just a side note John, could you delete those 8 spam threads? Some gayboy has flooded the forum with crap
